Please read these Terms of Service ("Terms") carefully before using any service provided by Gravenized LLC ("Gravenized," "we," "us," or "our"), including the Gravenized Market Alerts SMS program. By accessing our services or submitting your information, you agree to be bound by these Terms.

1. Description of Service

Gravenized LLC provides informational services including, but not limited to, the Market Alerts SMS program — an automated, signal-based notification service that delivers market condition indicators to subscribed mobile numbers. Access to this service is by invitation only and subject to availability.

2. SMS Market Alerts Program

By opting into the Gravenized Market Alerts program, you agree to the following terms specific to SMS messaging:

Consent: You expressly consent to receive automated text messages from Gravenized LLC at the mobile number you provide
Frequency: Message frequency varies based on market conditions — typically 0–3 messages per day
Rates: Message and data rates may apply based on your mobile carrier plan
Opt-Out: Reply STOP to any message to unsubscribe immediately from all future messages
Help: Reply HELP for assistance or contact gravenizer@gravenized.com
Carriers: Carriers are not liable for delayed or undelivered messages
Eligibility: You must be 18 years of age or older and a resident of the United States to participate

3. Not Financial Advice

All content delivered through Gravenized services, including Market Alerts SMS messages, is for informational purposes only. Nothing provided by Gravenized LLC constitutes financial advice, investment advice, trading advice, or a recommendation to buy or sell any security, ETF, or financial instrument. You are solely responsible for your own investment decisions.

Gravenized LLC is not a registered investment adviser, broker-dealer, or financial institution. Past signal performance does not guarantee future results. Always consult a qualified financial professional before making investment decisions.

4. Eligibility and Access

The Market Alerts service is a private program. Gravenized LLC reserves the right to grant, deny, suspend, or revoke access to any individual at any time, for any reason, without notice.

5. User Responsibilities

You agree to:

Provide accurate information when registering for the service
Maintain the confidentiality of any access credentials
Use the service only for lawful, personal purposes
Not redistribute, resell, or share alert content without written permission

6. Intellectual Property

All content, signals, methodologies, branding, and materials associated with Gravenized LLC are the exclusive property of Gravenized LLC and are protected by applicable intellectual property laws. Unauthorized use is strictly prohibited.

7. Disclaimer of Warranties

The services are provided "as is" and "as available" without warranties of any kind, express or implied. Gravenized LLC does not warrant that services will be uninterrupted, error-free, or accurate at all times. Signal delivery is dependent on third-party telecommunications providers.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Gravenized LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to financial losses arising from reliance on information delivered through our services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
